These Terms of Service (this “Agreement”) are a binding contract between you and PenCraft.ai (“PenCraft,” “we,” or “us”). This Agreement governs your access to and use of PenCraft's AI-Powered Educational Assistant services.

PLEASE READ THIS AGREEMENT CAREFULLY TO ENSURE THAT YOU UNDERSTAND EACH PROVISION. THIS AGREEMENT CONTAINS AN ARBITRATION AGREEMENT AND A CLASS ACTION/JURY TRIAL WAIVER THAT REQUIRE THE EXCLUSIVE USE OF FINAL AND BINDING ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES BETWEEN YOU AND US, INCLUDING ANY CLAIMS THAT AROSE OR WERE ASSERTED BEFORE YOUR ACCEPTANCE OF THESE TERMS.

5. Subscription Plans and Payments

PenCraft shall not be liable for any direct, indirect, or consequential damages arising out of or related to the use or inability to use our services, including any educational content generated by our AI.

These terms shall be governed by the laws of the jurisdiction where PenCraft is registered. Any disputes shall be resolved through binding arbitration in accordance with the laws of that jurisdiction.

We reserve the right to modify or update these Terms of Service at any time. Your continued use of PenCraft.ai constitutes acceptance of any changes to these terms.
